*By accessing this website, the LandLord Client Portral, or LandLord Leasing (the “Service”), you (“you”/ the ”User”) are agreeing to Landlord’s (the “Company’s”) Terms of Use. Please review the Terms of Use carefully before proceeding.

You agree and acknowledge:

Agreement

1. That these Terms of Use affect your legal rights and obligations, and that the Service cannot be used if you do not agree with the Terms of Use. Your use of the Service means that you agree fully with the Terms of Use. If you do not agree to the Terms of Use, do not access or use the Service.

REPRESENTATION AND LIABILITY

2. Use of this Service does not constitute a binding, true, or legally-enforceable representation agreement between you and the Company, and the Company will not be held responsible or liable for any consequence or expense, including but not limited to those of a financial nature, that occurs as a result of or in conjunction with your use of the Service

DISRUPTION AND INTERFERENCE

3. Under no circumstances may you:

  • Use this Service to violate or assist in violating any law, rule, or regulation.
  • Interfere with or disrupt the Service, which is considered to include all its computer systems, servers, networks, databased, hardware, software, smartphones, cellphones, or other equipment or technology that operates towards the end of actualizing the Service.
  • Interfere with other Users ability to use and enjoy the Service.
  • Attempt to gain unauthorized access to user-restricted areas of the website, logins and passwords belonging to other Users, or personal information and accounts belonging to other Users.

TERMINATION

4. In all instances where we believe that you have not complied with these Terms of Use, we may, at our sole discretion and without notice, terminate your access to the Service.

5. That we reserve the right to terminate your access to the Service, without cause or notice, at our sole discretion.

6. That all clauses and provisions of this Terms of Use that, by their nature, should survive termination of your access to the Service, shall survive termination.

TAX CALCULATOR

7. That information provided via our Land Transfer Tax Calculator is not guaranteed to be accurate, complete, or suitable for any use. This tool is offered by the Company to assist the User with understanding some of the additional costs that are inherent to the process of purchasing a property, and, while we believe the tool to be reliable, we cannot guarantee it as such. The accuracy of this tool is variable and subject to change without notice.

MLS/TREB

8. All MLS data accessed or obtained through the Service is intended only for non-commercial, strictly personal use by the User.

9. You have a true and genuine interest in the purchase, sale, or lease of real estate of a type offered through this service.

10. You are prohibited from copying, re-distributing, or otherwise sharing or using any of the listing information or other data provided through the Service, except where directly in connection with your own, personal real estate transaction or interest in completing a real estate transaction with the help of the Service.

11. That the Toronto Real Estate Board (“TREB”) is the legal owner of the MLS database and all data obtained through that database, which includes Listing Information.

12. You are prohibited from engaging in any activity that is intended to collect, publish or broadcast, display, summarize, post, distribute, store, alter or manipulate, re-organize, re-distribute, or sell or sublicense Listing Information or any related content, including all data supplied by TREB.

13. That TREB, TREB members, or representatives acting on behalf of TREB or its members, may need to access the Service or content shared via the Service for the purpose of confirming compliance with MLS Rules and Policies, and that the Company will comply in such cases.

ACCURACY

14. While we believe that the information provided through the Service is reliable, we do not guarantee that it is accurate, complete, or suitable for any purpose and such information is subject to change without notice. The User will take all reasonable steps and precautions to verify the accuracy, completeness, and suitability of any information procured through the Service, and will not hold the Company liable in any case where the information is found to be erroneous, incorrect, incomplete, or unsuitable for any use, whether partially or completely.

INTELLECTUAL PROPERTY

15. That the Service and all original content, features, and functionality that comprise it, including but not limited to our logo, website design, and mobile app, are owned by the Company and protected by all relevant international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
